Facebook inks major music licensing deal with Apra Amcos

Australian performance and mechanical rights society Apra Amcos has signed a major licensing agreement with Facebook.

The deal arrives after the social media giant secured long-term licensing agreements with all three major labels––Sony Music, Universal Music Group, and Warner Music as well as global digital rights agency Merlin, which represents over 20,000 indie record labels and distributors.

“We are delighted to be working with Facebook to ensure the creative content of our members and affiliates that is used on the platform is fairly remunerated.” He added music rights holders “will be compensated for the use of their works on Facebook,” Apra Amcos CEO Dean Ormston said in a statement.

Under the terms of the agreement, Facebook has licensed millions of songs from Apra Amcos’ 95,000 international songwriters, composers, and publishers.

The deal covers usage of their works on Facebook, Oculus, Instagram, and Messenger.

Recently, Facebook had won exclusive rights to broadcast live Premier League soccer matches in southeast Asia. The multi-year deal, valued at around £200 million (USD 264.4 million), is Premier League’s first with the social network, that will broadcast matches in Thailand, Vietnam, Cambodia, and Laos from 2019 to 2022, which henceforth includes all 380 matches in 2019.

Facebook had 2.2 billion monthly active users and Instagram 800 million until the fourth quarter of 2017.

Strategic licensing is the method by which the developer of intellectual property, technology or a product embeds it in the licensee’s product for distribution. Strategic licensing deals are critically important to both parties as they require counsel to expend a lot of effort in negotiating and drafting them.

Price:

While some strategic licenses are flat-fee deals, most involve a royalty based on sales of the licensee’s products. We must define the net sales on which the royalty percentage will be based.

The scope of the license:

The main objective is to get sufficient rights for the company. In addition to the grant of the general license, the ability of the licensee to sublicense may be expected. If the licensee wants to sublicense under its own trademark, it will want to restrict the licensor’s ability to use that trademark.

Foreclosing Competition:

In-licensors frequently would like to foreclose competitors from doing a similar deal with the out-licensor. Clauses may be negotiated to bound the out-licensors agreements with named competitors of the in-licensor, or to restrict competition by duration, geography, or market segment.

Nevertheless, both parties need to feel their goals and concerns have been considered and addressed and, on balance, the deal is a fair one that makes sense for their business.

Nothing stands more in the way of a successful licensing transaction than the inability of either party to see things from the point of view of the other party.

If Aristotle had to say to this – This license needs to be a partnership for living well between your company and your licensee.

So, it’s the license who acts as the most important person, regardless of how influential and potential the licensor may be.

You should understand the key issues from the perspective of the other side to seek creative ways to get the deal done

However, it is mandatory that the corporate licensing team should have very good interpersonal skills to undertake the task of understanding.

If you wish to implement a successful licensing strategy, these things you should mind:

The first key is to do the groundwork by identifying the intellectual property that will be made available for licensing.

The second key is to communicate an unwavering commitment to licensing from the highest levels of the company so its importance to the company is fully understood and appreciated.

The third key is to set up the right type of organizational structure taking into account the nature of your company and the extent of its intellectual property portfolio available for licensing.

The fourth key is to select individuals for your corporate licensing team who embrace an Aristotelian business philosophy and to provide them with the authority and resources to succeed.

The fifth key is to insist that your corporate licensing team understand that enhancing the bottom line is achieved by searching for a fair deal.

Renaissance acquires US-based Jay Gems for Rs 200 crore

Indian jewellery designer and manufacturer Renaissance Jewellery has acquired US-based Jay Gems for Rs 200 crore, according to a report in Economic Times.

With this transaction, Renaissance adds a globally popular brand to its portfolio and forays into new markets such as China.

The deal will also help Renaissance Jewellery tap into the exclusive license agreement the New York-based firm has with Enchanted collection by Disney Fine Jewellery.

Disney is the biggest licensing company in the world, with USD 55.1 billion in global sales in 2017. Disney’s Enchanted collection features a variety of designs ranging from earrings, rings, and pendants.

The new acquisition is also in line with its strategy to secure licenses for global brands.

New York-based Jay Gems has a strong client base including Zale, JC Penny, Signet, Fred Meyer, and Riddles, with a strong presence across the US, the UK, and Canada.

“In 2016, RJL signed a license agreement with Hallmark to launch the Heart of Hallmark Jewellery collection,” Sumit Shah, Vice-Chairman, Renaissance Jewellery Ltd, told BusinessLine.

According to the ET report, the deal is expected to be announced next week.

In FY 2018, RJL saw a turnover of Rs 1,825 crore, growing at 24 percent over FY17. Whereas on the other hand, Jay Gems earned USD 79.54 million (Rs 554 crore) in FY 17. Interestingly, half of the sales came from its Enchanted collection.

Founded in 1995, Renaissance is the largest manufacturer and supplier of branded studded jewellery to major global retailers in the US, Canada, Europe, West Asia and Asia. The company has four manufacturing units in India (Mumbai and Bhavnagar), Bangladesh and Dubai.

Scopely brings the ‘Looney Tunes’ to mobile gaming

Game publisher Scopely has struck a deal with Warner Bros. Interactive Entertainment to bring Looney Tunes characters in the form of a mobile game including Bugs Bunny, Daffy Duck, Wile E. Coyoute, Yoemite Sam, Tweety Bird and others.

“We have worked really hard to make sure that we maintain the level of humour you would have gotten from the show, and level it up. We maintain the sense of fun: the dropping anvils, the rolling boulders,” Scopely chief revenue officer Tim O’Brien told Deadline.

Titled ‘Looney Tunes: World of Mayhem’ allows players to collect their favourite characters, build personalized towns, battle with neighbours in prank-combat and cause mayhem.

The multiplayer mobile game slated to be released this fall preserves the original comedy from the animated shorts giving a modern entertainment experience.

For Warner Bros, the deal represents a new avenue to monetize the Looney Tunes intellectual property.

“Looney Tunes: World of Mayhem” is available for pre-registration on Google Play, and will be available as a free download on both iOS and Android. The free-to-play game will include in-app purchases, which is a typical industry model.

Looney Tunes is an American animated series of comedy short films produced by Warner Bros. from 1930 to 1969 during the golden age of American animation, alongside its sister series Merrie Melodies. It was known for introducing such famous cartoon characters as Bugs Bunny, Daffy Duck, Porky Pig, Elmer Fudd, Tweety, Sylvester, Granny, Yosemite Sam, Foghorn Leghorn, Marvin the Martian, Pepé Le Pew, Speedy Gonzales, Tasmanian Devil, Road Runner, Wile E. Drake releases merchandise collection for his latest tour

Kiki do you love me? Well, I certainly do not know about Kiki, but Drake surely loves you! Wonder how?

The Canadian rapper has unveiled a range of accessories that will be sold online and at the concerts for his “Aubrey and the Three Migos Tour.”

Drake and the Migos finally kicked off the ‘Aubrey and the Three Migos Tour’ after a pair of delays owing to production issues. Coinciding with hitting the road in support of his Scorpion album, Drizzy released an extensive merchandise collection, available online and at every tour stop.


The 21-piece collection includes a range of Scorpion-themed items such as an array of emblazoned T-shirts, long-sleeves, hoodies, sweatpants and dad caps. Most products range in size from small to XXL. According to various media reports, the prices of the products range from USD 30 -120.

The “God’s Plan” and “In My Feelings” singer is currently on the road with hip-hop trio Migos. The tour began on July 26 with a concert in Salt Lake City and will cover 45 locations in the United States and 11 in Canada before it ends on November 7 in Edmonton, Alberta.

Thomson expects Rs 600 crore revenue from India in FY19

Thomson is eyeing revenues of Rs 600 crore this financial year.

According to a report in the Moneycontrol, the French consumer electronics brand, that made a re-entry into the Indian market in FY19 through its television business are antedating a good growth in sales in the upcoming festive season. Besides, the company will also be launching new models for the Indian market.

“The company have already seen sales of 30,000 units in June within 45 days of the launch,” Avneet Singh Marwah, CEO, SPPL said exclusively to Moneycontrol.

Thomson entered into an exclusive licensing agreement with Indian contract manufacturer, Super Plastronics (SPPL). Besides Thomson, Super Plastronics holds the license for other brands such as Kodak TV, Crown, and SVK.

Thomson TVs are sold only through the e-commerce website, Flipkart, and it will continue. No plans of setting up offline stores in the offing.

Though the demand was equal from both rural and urban areas, Marwah said the 4K television is their highest selling product. However, the major cause of concern remains the high rate of taxes on large-end television.

According to the report, the company had sold the TV sets across 14,000 pin codes across India and the 35 warehouses of Flipkart across India, that has led to the reduction in delivery time.

The line includes printed silk satin dresses with lace trim, a baby crop lace trim t-shirt collection featuring Polly Pocket Snail Ride, Polly Pocket Baby Seahorse or Olly Pocket Cereal, and a collection of jewellery. Jewellery incorporates Swarovski crystal, pearl, and rhinestone beads, as well as original Polly Pocket figurines, resulting in a series of clip-on and pierced earrings, necklace and bracelets.

Walmart, Ellen DeGeneres join hands to launch women’s fashion line

Comedian and talk show host Ellen DeGeneres to launch a women’s clothing line at Walmart, according to a Reuters report.

Titled as EV1, the collection will feature nearly 60 items, ranging from denim, tees bearing Ellen quotes, accessories and footwear. All the fashion products will be priced at USD 30 or less, with new items updating seasonally.

The multiyear deal is set to take effect on September 10, when the line will debut in over 2,300 Walmart stores and on Walmart.com.

The move is the latest attempt to foray into the apparel space and gain market share in the category. Earlier, Walmart had launched four private label clothing brands to boost sales in the category. Not only this, the retailer giant had also acquired several small online brands such as Shoebuy, Modcloth, and Bonobos last year to boost growth in the fashion sector.

Airtel, Ustad Amjad Ali Khan to bring a soulful rendition of national anthem

Airtel and famous Sarod player Ustad Amjad Ali Khan, supported by Amaan Ali Bangash and Ayaan Ali Bangash, have joined hands to create a special sarod rendition of the national anthem to honour the 72nd Independence Day of India.

The 72nd Independence Day will be celebrated in India on August 15 (Wednesday).
